Terms of Sale — Breach-Grade Messaging Audit
Last updated: 19 October 2026 · LEX/TERM-002
These Terms of Sale govern your purchase of the Breach-Grade Messaging Audit ("the Audit"). They apply in addition to our Terms of Service and Privacy Policy, and where those conflict with these, these Terms of Sale prevail for the Audit.
1. What these terms cover
The Audit is sold by Lex Empire Agency (Pty) Ltd, registration number 2026/570939/07, a company incorporated in South Africa ("Lex Empire", "we", "us"). The Audit is sold to businesses.
Nothing in these Terms limits, waives or excludes any right you may have under the Electronic Communications and Transactions Act 25 of 2002 — including the cooling-off right in section 44 and the cancellation right in section 43(3) — or under the Consumer Protection Act 68 of 2008 where that Act applies to you. Where these Terms conflict with either Act, the Act prevails.
By completing checkout you accept these Terms of Sale.
2. The Audit is a fixed, defined deliverable
Unlike the general service descriptions on this site, this clause is an offer. On payment we will deliver:
- a claim-by-claim audit of one page you nominate, each claim extracted verbatim and stamped under our published methodology;
- one section of that page — usually the hero — rewritten in full;
- a prioritised list of the remaining issues; and
- a 30-minute walkthrough call with you and up to two colleagues.
"One page" means a single URL: your homepage or your primary product or sales page. It does not include other pages, PDFs, decks, emails or sub-pages linked from it.
3. What we need from you, and when the clock starts
Within one business day of your payment we will email you an intake form of four questions.
The five-business-day delivery period starts on the later of (a) our receipt of your completed intake form and (b) the expiry of the cooling-off period in clause 3A — unless you have consented under clause 3A to our starting sooner. Business days are Monday to Friday excluding South African public holidays.
If we have not received your completed intake form within 30 days of payment, we will contact you to arrange delivery. We will not treat the Audit as forfeited, and your right to a refund under clause 3A or clause 9 is unaffected by any delay in returning the form.
3A. Statutory cooling-off
You may cancel this purchase within seven days of payment, without reason and without penalty. Email us and we will refund the fee in full within 30 days. If we have already delivered any part of the Audit, you must stop using it and delete the materials.
Starting sooner, if you want to. By returning the intake form inside the seven-day period you ask us to begin work before the cooling-off period expires, and you consent to our doing so. You acknowledge that once the Audit has been delivered in full, the section 44 cooling-off right may no longer be available to you. You do not have to return the form inside seven days; if you would rather keep the right intact, wait, and the clock in clause 3 starts when the period expires.
This right is separate from and additional to the refund in clause 9.
4. Delivery
We will deliver the written Audit within five business days of the clock starting under clause 3, and offer the walkthrough call within ten business days of delivering it, at a time we agree. If we cannot meet that period we will tell you before it expires and give a revised date.
5. Questions and corrections
The Audit includes the walkthrough call and one round of written follow-up questions within 14 days of delivery. Factual corrections — where we have misread your page or misdescribed your product — will be made at no charge and are not limited to one round.
The Audit does not include rewriting further sections, re-auditing a changed page, or implementation. Those are separate engagements.
6. What the Audit is not
Please read this clause. It defines the limits of what you are buying.
- We audit words, not systems. The Audit assesses how your claims read to a sceptical technical buyer. It is not a security assessment, a penetration test, a code review, an architecture review, or any opinion on whether your product is secure or performs as described.
- You acknowledge and agree that the Audit is a marketing and communications review only. It does not constitute, and may not be represented as, any form of technical assurance, security certification, compliance attestation, or professional opinion on the security, functionality or performance of your product or service. You are solely responsible for obtaining any such assessment from a qualified provider. You indemnify Lex Empire against any claim, loss or liability arising from any representation by you or on your behalf that the Audit constitutes any form of security or technical assurance.
- We do not verify your technical claims. Where we say a claim is unverifiable, we mean a reader cannot check it from your page — not that it is false. Where we say a claim is sound, we mean it is specific and checkable, not that we have tested it.
- No outcome is promised. The Audit does not guarantee any increase in leads, conversions, pipeline, funding or sales.
- It is not legal, financial or compliance advice. If a claim on your page carries regulatory consequences, take your own advice on it.
7. Your content, and how we use AI
AI assists our research and first drafts. A person reviews, rewrites and signs off every line we deliver. You are buying our judgement, not a model's output.
You confirm that you have the necessary rights and consents to provide any content you submit to us, including any personal information of third parties. We process submitted content solely to deliver the Audit. We do not use it to train AI models and do not disclose it to any third party for that purpose. Where AI tools are used they are used under our instruction and subject to confidentiality obligations.
8. Ownership of what we deliver
On receipt of full payment you own the rewritten section and the fix list we deliver, and may use, modify and publish them without restriction or attribution.
We retain ownership of The CISO Filter methodology, our stamp taxonomy, our templates and our internal materials.
9. Refunds
If, on the walkthrough call, you tell us the Audit showed you nothing you did not already know, we will refund the fee in full. Raise it on the call or within five business days of it. You keep the Audit document; we do not ask for it back.
To process it: we will send you a written refund confirmation within two business days of your request, and you confirm in writing that the Audit showed you nothing you did not already know. On receipt of that confirmation we refund to the original payment method within ten business days.
This refund is in addition to the cooling-off right in clause 3A. If you cancel under clause 3A within seven days you are entitled to a full refund whether or not the walkthrough call has happened, and you do not have to attend it first.
Where a refund is made, the licence in clause 8 ends, except that you may keep using anything you had already published in good faith.
10. Confidentiality
Each party will keep confidential the other party's confidential information disclosed in connection with the Audit, and will not disclose it to a third party without the other's prior written consent, except as required by law. This obligation survives for five years.
Separately and without time limit: we will not publish, quote or identify your company, your page or your Audit in a teardown, case study, testimonial or any marketing material without your prior written permission. If you give that permission you may withdraw it at any time, and we will remove the material within 30 days of your written request.
11. Payment, currency and tax
The fee is $500 United States dollars, payable in full at checkout. Your bank or card issuer may apply conversion or cross-border charges that we neither set nor receive.
The fee is exclusive of any VAT or other tax applicable in your jurisdiction. You are responsible for any such tax.
If you have a problem with the Audit, tell us first. Raising a chargeback before contacting us prevents us from resolving it, and we will contest any chargeback brought without a prior attempt to resolve.
12. Limitation of liability
Please read this clause carefully. It limits our liability to you.
To the fullest extent permitted by law, and except where the Consumer Protection Act 68 of 2008 applies and prohibits such limitation, our total liability arising from the Audit is limited to the fee you paid for it, and we are not liable for indirect or consequential loss, including lost revenue, lost opportunity or lost pipeline.
Nothing in these Terms excludes or limits our liability for gross negligence, or any other liability that cannot lawfully be excluded or limited.
13. Governing law
These Terms of Sale are governed by the laws of the Republic of South Africa, and the South African courts have jurisdiction over any dispute.
